What is Compulsory Acquisition?

Compulsory acquisition is a statutory process under the Land Acquisition (Just Terms Compensation) Act 1991. The Act sets out the process that Government must follow when it is necessary to acquire property using a compulsory process. The statutory process also provides the means for resolving disputes about the amount of compensation that is payable to you. Claims can be made for tenants as well as owners of land. A business that trades from a premise will usually also have a separate claim for compensation. BNC Lawyers have acted in many compulsory acquisition cases and have consistently achieved far better outcomes and agreements than all initial offers. We have experience in projects such as Sydney Metro in the North where we acted for many commercial owners with businesses in the CBD, North Sydney and Crow’s Nest. We acted for owners and tenants including for all the businesses in a shopping arcade in the Sydney CBD. We also acted for clients in Western Sydney for the upgrade of the Northern Road against the RMS. We have acted on the F6 project, Westconnex and the Beaches Link. Even in projects such as the Beaches Link that have not officially received the full Government approval, we have been able to bring forward acquisitions where owners sought to do so, and worked collectively, with 10 owners who were affected by the Beaches Link. BNC Lawyers acted for 12 owners of homes in Randwick when Health Acquisition Authority acquired a total of 90 properties adjoining the Prince of Wales Hospital and had the largest number of clients than any other firm.We also act against Councils including Liverpool, Blacktown Council and Cumberland Council for residents who were having their homes acquired. 10 guiding principles of property acquisition

5. The process allows you adequate time for consideration, negotiation, decision-making and relocation, without unduly delaying the project. The timelines and deadlines are clearly explained.
6. The valuation and acquisition process is fair, consistent and transparent based on ‘market value’ not reinstatement.
7. Clear reasons and explanations are given for financial calculations, offers and terms of settlement.
8. A full suite of support options and entitlements are unambiguous, easy to understand, simple to access and straightforward to administer.
